Terms of Use

1. Agreement to Terms

By downloading, installing, or using Pacy ("the app"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the app. These terms are in addition to Apple's Standard End User License Agreement (EULA).

2. Description of Service

Pacy is an iOS savings tracker application that helps users:

• Create and manage a wishlist of desired items with savings goals
• Track savings progress with the "Ghost Pacer" visual indicator
• Allocate deposits intelligently across multiple items (Smart Deposit)
• Manage unallocated funds through the Pool feature
• Visualize savings progress with charts and statistics

All data processing occurs entirely on your device. The app does not provide financial advice and is intended as a personal budgeting tool only.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the app on any Apple device that you own or control, as permitted by the App Store Terms of Service.

4. Restrictions

You agree not to:

• Copy, modify, or distribute the app or its content
• Reverse engineer, decompile, or disassemble the app
• Attempt to extract source code from the app
• Use the app for any unlawful purpose
• Remove or alter any proprietary notices or labels
• Use the app in a way that could damage or impair its functionality

5. Subscription Terms

5.1 Free Version

Pacy provides core functionality for free with certain limitations on the number of items and features available. The free version displays banner advertisements provided by Google AdMob. By using the free version, you consent to the display of advertisements and the collection of certain device information by Google AdMob as described in our Privacy Policy.

5.2 Pacy Pro

The app offers the following premium plans:

• Monthly Subscription: Billed monthly at the price displayed in the App Store
• Annual Subscription: Billed annually at the price displayed in the App Store
• Lifetime Purchase: One-time payment for permanent access

5.3 Free Trial

Subscription plans may include a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

5.4 Billing and Renewal

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

5.5 Refunds

All purchases are processed by Apple. Refund requests must be submitted to Apple directly through their support channels.

6. User Content and Data

You retain full ownership of all data you enter into the app. Since all data is stored locally on your device:

• You are responsible for backing up your data
• Uninstalling the app will permanently delete all data
• We cannot recover lost data as we do not have access to it

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

Important: Pacy is a personal budgeting tool and does not provide financial advice. Savings calculations and projections are estimates only and should not be relied upon for financial decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR FINANCIAL LOSSES ARISING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, losses, or expenses arising from your use of the app or violation of these Terms.

10. Updates and Modifications

• We may update the app from time to time with bug fixes, new features, or improvements
• We reserve the right to modify these Terms at any time
• Continued use of the app after changes constitutes acceptance of the modified Terms

11. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we handle your data.

12. Termination

• You may stop using the app at any time by deleting it from your device
• You may cancel your subscription at any time through Apple ID Account Settings
• We reserve the right to terminate or suspend access to the app at our discretion

13. Third-Party Services

The app uses the following third-party services:

• Apple StoreKit — For in-app purchases and subscription management. Your use of Apple's services is governed by Apple's Terms of Service.
• Google AdMob — For displaying banner advertisements in the free version. Your use of Google's ad services is subject to Google's Terms of Service.

We are not responsible for the services or policies of these third parties.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms or the use of the app shall be subject to the exclusive jurisdiction of the Tokyo District Court.

15. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy and Apple's Standard EULA, constitute the entire agreement between you and the developer
• Severability: If any provision of these Terms is found invalid, the remaining provisions will continue in effect
• No Waiver: Failure to enforce any provision does not constitute a waiver of that provision
• Assignment: You may not assign your rights under these Terms without our prior written consent
• Force Majeure: We shall not be liable for any failure or delay caused by circumstances beyond our reasonable control
